DUI Laws

Understanding DUI

Although DUI and DWI laws vary from state to country, since 2002, all 50 states have made it illegal by themselves (inherently illegal) to drive with an alcohol content in the blood (BAC) or 0.08%. States also consider "drunk driving" to consist of either 2 separate offenses: DUI or DWI and the level of alcohol content in illegal blood by itself. If a blood alcohol test is duly federal, a person may be accused and convicted for both offenses. Many, if not all, states have enacted other laws to deal with DUI as well.

Zero Tolerance

The federal law adopted in 1995 requires States to declare a zero tolerance for the laws on blood alcohol content for drivers under the age of 21 or who lose funds from the federal highway. Zero Tolerance makes it illegal for anyone under the age of 21 to drive with an alcohol content in the blood or 0.02%.

Many states have tasks that require a further step and limit drivers under 21 to 0.00% or 0.01% of the blood alcohol content. The descent at the level of alcohol found with a federal test, penalties range from administrative hearings with criminal prosecution.

Implied Consent

The 50 states have set implicit permission laws, and most people don't even realize it. When he approved a driving licence, he also agreed to undergo chemical tests--breathing, blood, or urine--for the content of alcohol in the blood when he was duly requested to apply the law.

Enhanced Penalty Laws

Many states also have gone further than the per se law for blood alcohol content. Many have enacted improved criminalization laws for people with alcohol content in the blood from 0.15% or more – some states require a higher BAC for better sanction. Penalties for a higher alcohol content in the blood are much harder than the penalties under the elevated penalty levels if condemned. Given the differential penalties and blood alcohol levels required from state to state, you should have an experienced DUI attorneys to help you cope with the legal intricacies of a DUI levy, regardless of your age or alcohol level in the blood.
